1. About these terms
These Terms of Use govern your use of Cromática’s website, including its portfolio, journal, service information, and contact features. The website is operated by Cromatica Studio, LLC, a Texas limited liability company doing business as Cromática. “Cromática,” “we,” “us,” and “our” refer to Cromatica Studio, LLC.
Please read these terms before using the website. If you do not agree, please stop using it. Our Privacy Policy explains how we handle personal information in connection with the website and inquiries.
2. Website information and our services
This website introduces our branding and creative services and provides examples of our work. Descriptions, examples, timelines, and other information are general information, not a binding offer or a promise of a particular result.
Sending an inquiry does not reserve availability, place an order, or create a client relationship. A project begins only when we enter into a separate agreement with you. That agreement determines scope, fees, payment, scheduling, revisions, cancellation, confidentiality, and ownership or licensing of deliverables. If it conflicts with these website terms on a project matter, the project agreement controls.
3. Ownership and permitted use
The website’s design, text, graphics, photographs, videos, and other content belong to Cromática or their respective owners and are protected by applicable intellectual property laws. Client names, logos, and portfolio materials remain subject to the rights of their owners. Showing work in our portfolio does not give visitors a license to use it.
You may view the website and share links to its publicly available pages. You may not reproduce, sell, distribute, modify, or use its content in your own branding or other commercial materials without permission from the relevant rights holder, except where applicable law permits that use.
4. Responsible use
Do not use the website for unlawful activity, impersonation, harassment, spam, or infringement of another person’s rights. Do not introduce malicious code, attempt unauthorized access, bypass security controls, or interfere with the website’s availability.
We may restrict access where reasonably necessary to protect the website, its users, or others, or to comply with law.
5. Information you send us
Provide accurate contact details and only information you are authorized to share. Please do not send sensitive personal information, passwords, payment-card details, or confidential materials through an initial website inquiry or unsolicited email.
An unsolicited inquiry does not itself create a confidentiality agreement. If your project requires confidential disclosure, contact us to arrange an appropriate agreement first. You retain your rights in materials you send us; sending them does not transfer ownership to Cromática or grant permission to publish them.
6. Links to other websites
The website may link to social networks, client websites, portfolio platforms, or other third-party services. Those services operate under their own terms and privacy policies. We do not control their content or practices. A link does not necessarily mean we endorse the service or everything on it.
7. Availability and accuracy
We aim to keep the website useful and accurate, but information may change or contain errors. We may update, remove, or temporarily suspend pages or features. To the extent permitted by law, the website is provided as available, without a guarantee of uninterrupted access, error-free content, or suitability for a particular purpose.
Nothing in these terms excludes a warranty or other protection that applicable law does not allow us to exclude.
8. Responsibility for loss
To the extent permitted by applicable law, Cromática is not responsible for indirect or consequential losses arising from use of, or inability to use, the website. This does not exclude or limit responsibility for fraud, intentional misconduct, or any liability that cannot lawfully be excluded or limited. Responsibility for commissioned services is addressed in the applicable project agreement.
9. Changes to these terms
We may revise these terms as the website or our practices change. We will publish the revised terms here and update their effective date. Changes apply prospectively. If a change requires additional notice or agreement under applicable law, we will follow that requirement.
10. Applicable rights and disputes
These terms are governed by the laws of the State of Texas, United States, except where mandatory applicable law provides otherwise. They do not take away mandatory consumer or other rights you have under the laws applicable to you. If you have a concern about the website, please contact us so we can try to resolve it. A project agreement may contain separate governing-law and dispute provisions for that project.
